The following is a copy of the “Chair's Final Report” that addresses the disposition of a complaint I made against the RCMP in the summer of 2001. When I made the complaint I had very little knowledge of what took place behind the scenes with the RCMP, I just knew something was not right. In the coming years and through both the criminal and civil trials that followed, I was able to obtain hundreds of internal RCMP documents, some of which I gave to Mr. Kennedy for his review.

The allegation that is at the center of this report is very specific and can be found on page two.

In looking at it objectively as possible, knowing that I do come at this with some presuppositions, I can only somewhat agree with Mr. Kennedy's conclusions.

I will save my opinion of this report for now as I have filed a new complaint which I have also included here; I will address this one and if need be the new one after I have received a response from the commission.

COMMISSION FOR PUBLIC COMPLAINTS AGAINST THE RCMP

NEW COMPLAINT TO THE COMMISSION

Mr. Paul Kennedy,

I would like to first point out that this complaint is not a rebuttal to File No: PC 2008-2958. That file was in response to the handling by the RCMP of a complaint against them in 2001 regarding the actions of two Halifax officers by the names of Doug Hayre and Wayne Williams. This complaint comes from having a chance to peruse the hundreds of documents since 2001 and now having a better understanding of what went on behind RCMP doors in regards to the Sean Simmons murder. I am not going to supply more documents as you can retrieve the information from the above mentioned file, however I will include a copy of a book that I recently had published which gives what I believe to be an accurate and true picture of what took place. I am requesting not only a look into this incident but I am asking for a public inquiry into the actions of the RCMP before during and after the Sean Simmons murder. The information I would like an investigation into and answers to are as follows:

  1. How Cpl. Al Comeau’s personal issues with me may have caused him to act unprofessional, if not negligent in utilizing information given by me regarding a planned murder.(I would suggest maybe reading from question 652 onward in the examination of Al Comeau)
  2. Why did Assistant Commissioner Mike Cabana, knowing me to be reliable and knowing that I was involved in a murder plot, not go to superior officers to pass on the information on what was taking place in Halifax?
  3. If he did pass the information on, where are the documents that reflect that?
  4. I was in constant contact with Mike Cabana in the weeks leading up to the murder, yet that is disputed. Many of the calls were collect to Cabana and the rest were from our home phone...why were these records not used by those investigating this incident to verify the communication between us?
  5. Was the lack of Contemporaneous note-taking or lack of any note-taking at all by Doug Hayre, Wayne Williams, and Al Comeau, Phil Barrett or Mike Cabana a coincidence or normal practice for all of these seasoned investigators?
  6. Did the RCMP lie, via Al Comeau, to the Federal Court during the examination for discovery in the lawsuit regarding the Sean Simmons murder?
  7. Did the “Treacherous” label stop Hayre and Williams from dealing with me and was the label legitimate?
  8. The RCMP had a reliable source telling them that he was going to be involved in a planned homicide, that he knew who the killers were and that he would be driving the car, however it is alleged that this was not enough information to prevent it. Why is it that we were able to prevent an attempted robbery with violence against an elderly man in Richibucto NB in a similar situation with less information in 1991? Why were we able to prevent further violent armed robberies by two escaped federal inmates as I drove them about their business in 1992?

Mr. Kennedy, both sides cannot be telling the truth in this situation. If it is me that is not being truthful then I think that there are four people who should not be in jail based on my testimony against them. If I am telling the truth, then it is time for the RCMP to be held accountable for their actions in this matter.
